This website is operated by Stephens Premier Limited, trading as Leica Store Manchester ("we", "us", "our"). Throughout this site, "we", "us" and "our" refer to Leica Store Manchester. These Terms of Service ("Terms") apply to all purchases made from us — whether in person at our store or online at leicastoremanchester.com (the "Site") — and to all use of the Site itself, including browsing, account registration, and any other Service we make available.

By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms, including any additional terms, conditions, and policies referenced here or available by hyperlink (including our Privacy Policy, Refund Policy, and Warranty & Guarantee page). Please read these Terms carefully. Nothing in these Terms affects your statutory rights as a consumer.

We reserve the right to update these Terms at any time by posting changes to this page. It is your responsibility to check this page periodically. Continued use of the Site or a new purchase after changes are posted constitutes acceptance of the updated Terms. The version in force at the time you place an order applies to that order.

Our online store is hosted on the Shopify platform, which provides the e-commerce infrastructure that allows us to sell to you online.

Leica Store Manchester is an authorised retailer of products manufactured by Leica Camera AG and distributed in the UK by Leica Camera Limited. We are an independent business and are not owned or operated by Leica Camera AG or Leica Camera Limited. "Leica" and related marks are trademarks of Leica Camera AG and are used with permission/under licence as an authorised dealer.

2. Definitions

  • "Goods" means any products offered for sale by us, including new and Pre-Owned photographic and sport optics equipment.
  • "Pre-Owned Goods" means used, second-hand, ex-demonstration, or trade-in equipment sold by us.
  • "Order" means a request by you to purchase Goods from us, whether placed in-store or via the Site.
  • "Consumer" has the meaning given in the Consumer Rights Act 2015 — broadly, an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
  • "Service" means the Site and any related content, tools, or functionality we make available.

3. Online Store Terms

3.1 By using the Site, you confirm you are at least 18 years old, or that you are using the Site under the supervision of a parent or guardian.

3.2 You must not use the Site or our Service for any unlawful purpose, or in a way that breaches any applicable law or regulation (including intellectual property law), in your jurisdiction or ours.

3.3 You must not transmit any worms, viruses, or other code of a destructive or disruptive nature via the Site.

3.4 A breach or violation of any of these Terms may result in immediate termination of your access to the Service.

4. General Conditions

4.1 We reserve the right to refuse service to anyone, for any lawful reason, at any time.

4.2 Any content you submit through the Site (not including payment card details) may be transmitted unencrypted and may involve transmission over various networks. Payment card information is always encrypted in transit.

4.3 You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of the Service, or access to it, without our express written permission.

4.4 Headings in these Terms are for convenience only and do not affect their interpretation.

5. Accuracy, Completeness and Timeliness of Site Information

5.1 We are not responsible if general information made available on the Site is inaccurate, incomplete, or out of date. Site content is provided for general information only and should not be relied on as the sole basis for a decision.

5.2 The Site may contain historical information, which is provided for reference only. We reserve the right to modify Site content at any time without obligation to update it.

5.3 This section does not affect the accuracy requirements that apply to specific product descriptions and prices at the point of sale, covered in Section 6 below.

6. Products, Descriptions and Pricing

6.1 We take reasonable care to ensure that descriptions, specifications, and images of Goods on the Site and in-store are accurate. Colours may vary slightly depending on your display settings, and we cannot guarantee your monitor will display colours perfectly accurately.

6.2 Pre-Owned Goods are individually inspected and graded (e.g. Excellent / Very Good / Good / Fair) based on their cosmetic and functional condition. The condition grading and any noted defects, marks, or missing accessories will be described at the point of sale. Please ask a member of staff, or refer to the product listing, for full condition details before purchasing.

6.3 All prices are shown in GBP (£) and are inclusive of UK VAT at the applicable rate, unless stated otherwise. Prices exclude delivery charges, which will be shown separately at checkout for online orders. Prices, product descriptions, and availability are subject to change at any time without notice, and we reserve the right to discontinue any product at any time.

6.4 We reserve the right to correct any pricing, typographical, or description errors at any time before an order is dispatched or collected — including after you have submitted an order. If we discover an error after you have placed an order, we will contact you to confirm whether you wish to proceed at the correct price, or cancel your order for a full refund.

6.5 We reserve the right, but are not obliged, to limit sales of any product to any person, household, or geographic region, and to limit or refuse orders that in our reasonable judgment appear to be placed by dealers, resellers, or distributors rather than genuine end customers.

7. Placing an Order and Your Account

7.1 In-store purchases: A contract of sale is formed when you make payment in-store and receive your receipt.

7.2 Online purchases: Adding an item to your basket does not guarantee its availability. A contract is formed only when we send you an order confirmation email accepting your order. We may decline or cancel an order at our discretion (for example, in the event of a pricing error, stock unavailability, or suspected fraud), in which case we will notify you and refund any payment taken.

7.3 You agree to provide current, complete, and accurate information when placing an order or setting up an account, and to promptly update it (e.g. email address, billing details) so we can complete transactions and contact you as needed.

7.4 You must be at least 18 years old and have legal capacity to enter into a contract to place an order.

8. Payment

8.1 We accept the payment methods shown at checkout or in-store (e.g. debit/credit card, and finance options where available). Payment for online orders is taken at the point of order, or as otherwise stated at checkout.

8.2 Part-exchange and trade-in valuations, where offered, are subject to physical inspection of the item on receipt and may be adjusted if the item's condition differs from that described by you.

9. Your Right to Cancel (Online and Distance Sales Only)

9.1 If you are a Consumer and you purchased Goods online, by phone, or by any other means without both parties being physically present together (a "distance sale"), you have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

9.2 This cancellation right lasts for 14 days beginning the day after you (or someone you nominate) receives the Goods. To cancel, you must inform us clearly (e.g. by email to hello@leicastoremanchester.com) before the 14-day period expires.

9.3 Once you have told us you wish to cancel, you must return the Goods to us within 14 days, in the condition you received them, at your own cost (unless the Goods are faulty or not as described). We recommend using a tracked and insured delivery service, as you are responsible for the Goods until they reach us.

9.4 We will refund you within 14 days of receiving the returned Goods (or evidence that you have sent them back), using the same payment method you used to pay, unless agreed otherwise. We may make a deduction from the refund if the value of the Goods has been reduced by unnecessary handling on your part beyond what is needed to establish the nature and function of the item.

9.5 This right to cancel does not apply to in-store purchases where you were physically present, though this does not affect our separate Refund Policy (Section 10) or your statutory rights (Section 11).

9.6 This right to cancel is separate from, and does not replace, your statutory right to reject faulty goods described in Section 11.

10. Our Refund Policy

In addition to your statutory rights, we offer our own goodwill returns/exchange arrangements as set out in full in our Refund Policy, which forms part of these Terms. This goodwill policy is offered in addition to, and does not affect, your statutory rights under Section 11.

11. Your Consumer Rights (Faulty or Misdescribed Goods)

11.1 Under the Consumer Rights Act 2015, if you are a Consumer, Goods we sell to you must be:

  • of satisfactory quality;
  • fit for any particular purpose you made known to us; and
  • as described.

11.2 This applies equally to new and Pre-Owned Goods — however, what counts as "satisfactory quality" for Pre-Owned Goods takes into account their age, condition, and the price paid, as well as any condition grading and defects disclosed to you at the point of sale.

11.3 If a fault develops, your statutory rights broadly include:

  • Short-term right to reject: within the first 30 days, you may reject faulty Goods and get a full refund.
  • Right to repair or replacement: after 30 days (or if you choose not to reject within 30 days), you can request a repair or replacement.
  • Price reduction or final right to reject: if a repair or replacement is not possible, or does not resolve the fault, you may be entitled to a price reduction or to reject the Goods for a refund (which may be reduced to reflect use, for goods held more than six months).

11.4 These statutory rights exist regardless of, and in addition to, any manufacturer's guarantee or our own Pre-Owned Guarantee — see our separate Warranty & Guarantee page for details of guarantee coverage.

12. Delivery (Online Orders)

12.1 We aim to dispatch orders within [NUMBER] business days of order confirmation, or as otherwise stated at checkout. Delivery timescales are estimates and not guaranteed.

12.2 Risk in the Goods (e.g. loss or damage) passes to you on delivery. Title (ownership) passes once we have received payment in full.

12.3 For high-value items, we may require a signature on delivery and reserve the right to require age or identity verification.

13. Warranties and Guarantees

All Goods are covered by the guarantee terms set out on our Warranty & Guarantee page, which forms part of these Terms. In summary:

  • New Leica products are covered by the manufacturer guarantee provided by Leica Camera AG and/or Leica Camera Limited (currently 2 years from date of purchase, extendable to 3 years on product registration), subject to their own warranty conditions.
  • Pre-Owned products are covered by our own dealer guarantee against manufacturing defects — 2 years for products whose model was released within the last 10 years, or 1 year for all other Pre-Owned products — as set out in full on the Warranty & Guarantee page, including requirements for in-person inspection and non-transferability.
  • New products from partner brands (non-Leica) are covered by that manufacturer's own guarantee — a minimum of 1 year, with some brands and products offering longer or lifetime cover — as set out in the manufacturer's own paperwork and/or website.

The specific guarantee period, provider, and terms applicable to new and Pre-Owned Leica items are also confirmed on that item's own product page.

14. Optional Third-Party Tools and Links

14.1 We may provide access to third-party tools over which we have no control. These are provided "as is" and "as available", without warranty of any kind, and entirely at your own risk — please review the relevant third party's own terms before use.

14.2 The Site may contain links to third-party websites that are not affiliated with us. We do not review, endorse, or accept liability for third-party content, products, or services. Any transaction you enter into with a third party is between you and that third party.

15. User Comments, Feedback and Submissions

If you send us comments, ideas, or suggestions (whether requested or not), you agree we may use, edit, publish, and distribute them without restriction or compensation to you, and without obligation to keep them confidential or to respond. You agree not to submit anything unlawful, infringing, defamatory, or otherwise objectionable, and you remain solely responsible for the accuracy and legality of anything you submit.

16. Disclaimer of Warranties; Limitation of Liability

16.1 This section concerns use of the Service/website generally. It does not affect, and is subject to, your statutory rights as a Consumer under Section 11 above, which cannot be excluded or limited by these Terms. Nothing in this section excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under English law.

16.2 Subject to clause 16.1, we do not guarantee that the Site or Service will be uninterrupted, timely, secure, or error-free, and your use of the Site (as distinct from Goods you purchase, which are covered by Section 11) is at your own risk, provided "as is" and "as available" without warranties beyond those implied by law that cannot be excluded.

16.3 Subject to clause 16.1, and save for your rights as a Consumer in respect of Goods purchased under Section 11, we are not liable for any indirect, incidental, or consequential losses (such as loss of profit, revenue, or data) arising from your use of the Site or Service.

17. Indemnification

You agree to indemnify and hold harmless Leica Store Manchester and our officers, directors, employees, and agents from any claim or demand (including reasonable legal fees) made by a third party arising from your breach of these Terms or your violation of any law or third-party right. This clause does not apply to the extent it would seek to limit your statutory rights as a Consumer.

18. Prohibited Uses

You must not use the Site or its content: for any unlawful purpose; to solicit unlawful acts; to infringe our or others' intellectual property rights; to harass, abuse, or discriminate against any person; to submit false or misleading information; to transmit viruses or malicious code; to collect others' personal information without consent; to spam, phish, or scrape the Site; or to interfere with the security of the Site. We may terminate your access to the Site for any breach of this section.

19. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and severed from the remainder, which will continue in full force and effect.

20. Entire Agreement

These Terms, together with the policies referenced in them (including our Privacy Policy, Refund Policy, and Warranty & Guarantee page), constitute the entire agreement between you and us regarding your use of the Site and purchases from us, superseding any prior versions or communications, whether oral or written.

21. Intellectual Property

All trademarks, logos, and product names referred to on the Site (including "Leica") are the property of their respective owners. Nothing in these Terms grants you any rights in our (or any third party's) intellectual property.

22. Complaints and Alternative Dispute Resolution

22.1 If you have a complaint, please contact us at hello@leicastoremanchester.com in the first instance so we can try to resolve it directly.

22.3 You may also contact your local Trading Standards office or the Citizens Advice Consumer Service for guidance.

23. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms caused by events beyond our reasonable control, including but not limited to strikes, supply shortages, extreme weather, or failures of third-party carriers.

24. Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This does not remove any right you have as a Consumer to bring proceedings in the courts of the part of the UK in which you live.
